3. general information on data processing in the employment relationship
If you work for us as an affiliate partner of junglück GmbH, we collect and process your data (both in paper format and in digital form).

4. data processing for the execution of the contractual relationship
We process your data to fulfill your assignment as an affiliate partner on the basis of Art. 6 para. 1 b) GDPR. Sometimes the data processing is also carried out at the same time to fulfill legal obligations to which we are subject as an employer within the meaning of Art. 6 para. 1 c) GDPR.

We use the service provider Tapfiliate, Joop Geesinkweg 140, 1096 AT Duivendrecht, Netherlands (part of the Mitgo company, Heinz-Nixdorf-Straße 6, 74172 Neckarsulm, Germany) to determine your conversion rates and the resulting services to you.

Tapfiliate is hosted on Amazon Web Services (AWS) servers of Amazon Web Services EMEA SARL, 38 Avenue John F. Kennedy, L-1855, Luxembourg ("Amazon"). It is possible that data may also be transferred to Amazon Web Services Inc. in the USA.Amazon is certified under the EU-US Data Privacy Framework and is covered by the EU adequacy decision for the USA, provided that no data relating to the employment relationship or applicant data is processed. Amazon ensures an adequate level of data protection for this data processing via the EU standard contractual clauses. We process the following data for the purpose of billing your remuneration and to fulfill our tax obligations:

  • - Data in accordance with the contractual agreement on the activity as an affiliate partner
  • - Calculation of charges and invoice data (VAT number, name, invoice address)

5. duration of data storage
Your personal data will only be stored for as long as knowledge of the data is required for the purposes of the employment relationship or the purposes for which it was collected, or for as long as statutory or contractual retention requirements exist.

Different statutory retention periods result from tax, labor and social security regulations and extend up to ten years for documents and receipts relevant to tax law. After you leave our company, we will retain your personnel file for a period of ten years, for example.

In addition, personal data may be retained for evidence purposes for the period during which there is a possibility that claims may be asserted against our company (limitation period of three to thirty years).

On request, you can obtain information about all personal data that we have stored about you free of charge at any time.

b) Correction, deletion, restriction of processing (blocking), objection

If you no longer agree to the storage of your personal data or if it has become incorrect, we will arrange for the deletion or blocking of your data or make the necessary corrections (insofar as this is possible under the applicable law). The same applies if we are only to process data to a limited extent in future. You have the right to object in particular in cases where your data is required for the performance of a task carried out in the public interest or in our legitimate interest, as well as profiling based on this. You also have such a right to object in the case of data processing for the purpose of direct advertising.

c) Right to withdraw consent with effect for the future

You can withdraw your consent at any time with effect for the future. Your revocation does not affect the legality of the processing up to the time of revocation.

d) Data portability

If data processing is carried out on the basis of a contract, pre-contractual negotiations, consent or with the aid of automated procedures, you have the right to data portability. Upon request, we will provide you with your data in a commonly used, structured and machine-readable format so that you can transmit the data to another controller upon request.

e) Restriction of processing

Data for which we are not able to identify the data subject, e.g. if it has been anonymized for analysis purposes, is not covered by the above rights. Information, deletion, blocking, correction or transfer to another company may be possible with regard to this data if you provide us with additional information that allows us to identify you.
